Նիդեռլանդների ՀՅԴ Հայ Դատի հանձնախմբի հանդիպումը Շվեցարիայի դեսպանորդների հետ

Նիդեռլանդների ՀՅԴ Հայ Դատի հանձնախմբի նախագահ՝ Մասիս Աբրահամյանը 2014 թվականի փետրվարի 4-ին այցելեց Հաագայում Շվեցարիայի դեսպանություն և հանդիպեց դեսպանորդներ՝ Անյա Զոբրիստ Ռենտենարի և Ֆիլիպ Բրանդի հետ: Հանդիպման նպատակն էր՝ Շվեցարիայի կառավարությանը փոխանցել խնդրագիր հոլանդահայության անունից, առ այն, որ Մարդու Իրավունքների Եվրոպայի Դատարանի որոշումը Հայոց Ցեղասպանության ժխտող՝ Փեռինչեկի վերաբերյալ բողոքարկվի այդ երկրի արդարադատության նախարարության կողմից: Հանդիպմանը մասնակցում էր նաև Նիդերլանդների ՀՅԴ «Գարեգին Նժդեհ» երիտասարդական միության ներկայացուցիչ՝ Սեպուհ Աբրահամյանը: Հյուրերը հանգամանալից ներկայացրեցին հոլանդահայերի մտահոգությունները կապված ՄԻԵԴ-ի հայտնի որոշման հետ: Մասնավորապես ասվեց, որ դատավճիռը բավարար հիմնավորված չէ և այն հանգամանքը, որ որողումը միաձայն չի ընդունվել վկայում է այդ մասին: Խոսվեց Ֆրանսիայի նախագահ՝ Հոլանդի վերջին հայտարարությունների մասին, որոնք մեկ անգամ ևս ամրապնդում են ցեղասպանության ժխտման պատժելիության անհրաժեշտությունը:
Դեսպանորդները շնորհակալություն հայտնեցին այցի վերաբերյալ և խոստացան Հայ Դատի խնդրագիրը փոխանցել կառավարությանը: Ասվեց նաև, որ խնդիրն այս պահին գտնվում է արդարադատության նախարարության տնօրինության տակ և այնտեղ է կայացվելու բողոքարկման որոշումը: Ըստ նրանց կանխատեսման մինչև մարտի 17-ը տրված ժամանակը արդարադատության նախարարությունը լիովին կօգտագործի այս բարդ որոշումը կայացնելու համար: Նրանք նշեցին նաև, որ ամբողջությամբ ըմբռնում են հարցի կարևորությունը հայ ժողովրդի համար, այդուհանդերձ ՄԻԵԴ-ի անկախ կարգավիճակը սահմանափակում է նրա վրա ազդեցություն բանեցնելու հնարավորությունը:
Ի պատասխան այս պնդմանը պարոն Աբրահամյանը նշեց, որ մենք որևէ ազդեցություն ՄԻԵԴ-ի վրա Շվեցարիայի կողմից չենք ակնկալում: Մեր սպասելիքը օրենքի ընձեռած հնարավորություններն օգտագործելն է և դատավճիռը իրավաբանորեն բողոքարկելը: Եթե այդ քայլը չկատարվի հայ ժողովուրդը մեծ ափսոսանք և հիասթափություն կապրի: Նշվեց, որ Հայոց Ցեղասպանության հարյուրամյակին ընդառաջ չպետք է թույլ տալ ժխտողականության մի նոր հաղթարշավ, որը նոր ոգևորություն կառաջացնի ուրացողների շրջանում:
Հանդիպումն ավարտվեց ջերմ ձեռքսեղմումներով և հավաստիացումներով, որ զարգացումների մասին կողմերը միմյանց տեղյակ կպահեն:

In its decision of 17 December 2013, the European Court of Human Rights disgracefully awarded the genocide denier Dogu Perincek his appeal against the Swiss Government, effectively accusing Switzerland for infringing the freedom of expression.

In light of this severe matter we, members of the Hay Tad Committee, expressing the desire of the Armenian Community in The Netherlands, wish to draw your attention to the following points. As you will undoubtedly be aware of, are all of grave importance to Armenians all over the world.

  1. Firstly, the verdict of the ECHR is effectively questioning the fairness of Swiss legislature, which considers crimes against humanity, including the Armenian Genocide, as criminal offences punishable by law.
  2. Should the decision of the ECHR not be altered, it will be a severe blow to Armenian rights and to the efforts towards recognition of the Armenian Genocide. The first essential step towards having this decision changed is an appeal by the Swiss government, protesting against the decision of the ECHR. Consequently we, Armenians are ready to assist in every possible way to reach a desirable result. However, without an appeal to the ECHR to rectify the situation, the honourable intention of the Swiss government to uphold justice, will be turned into an instrument for violating the rights of the Armenian people.
  3. The fact that two of the seven judges on the panel strongly disagreed with the decision constitutes sufficient basis to expect a fundamental change in the final verdict, if an appeal is submitted. With this eventuality in mind, a possible decision by the Swiss government not to appeal against the verdict of the ECHR will be incomprehensible.

Thus, having in mind all the above, we, the representatives of the Armenian community in The Netherlands respectfully urge the Swiss government to lodge an appeal against this unfair and biased decision of the ECHR, which effectively condemns Switzerland for protecting the rights of genocide victims, against deniers and abusers of human rights, such as Mr. Dogu Perincek himself.
